Intellectual
Property - Licensing Information |
|
An Intellectual Property
Release Form (IPR Form) must be completed, signed and
dated for every new order. It is an industry standard
indemnity form where you state if you have the right to
manufacture the content on your disc. |

Mechanical Licensing
Mechanical Licensing is most commonly required for the
reproduction of Audio/Music CDs. If you're performing
your own version (commonly referred to as a 'cover'
version) of someone else's song, Mechanical Licensing
is a type of royalty that must be paid for each copy
of the song that gets reproduced. Separate licensing
agreements must be made for each individual 'cover'
song.

Master Licensing
If you are
using the original version of someone else's
intellectual property from CD, DVD, television, movie,
radio, etc., you will require Master Licensing for the
right to use that original content. This applies to
audio/music/sounds as well as video, and examples
include 'samples' and 'sound bytes' regardless of how
short the duration is.
Important: Taking a sample or sound-byte (regardless
of duration) and altering it in any way does not make
it your original composition. Licensing is still
required any time you have used content or a creation
that is not completely your own.
Important: If you use someone else's video content
that includes 'sound' you will likely have to deal
with the licensing of the video and the audio/sound
separately.

Making a Data/CDROM Disc?
Third-party utilities, drivers, applications and
shareware commonly have licensing or distribution
requirements - even if there is no fee or royalty
involved. This includes such common applications such
as Adobe Acrobat Reader, Quicktime, Real Audio, etc.
Utilities such as these must first be checked with the
vendor to see if they require distribution agreements.
